Ministry of Commerce lifts controls on coal exports to reduce legal overlap
Abolish the control of coal exports under the supervision of the Ministry of Industry under the Mineral Act B.E. 2560 to reduce legal duplication in regulating coal exports.
Abolish controls on coal exports
The Cabinet approved the draft announcement of the Ministry of Commerce to cancel the control of coal exports to reduce legal duplication in regulating coal exports. There is no need to request permission from the Ministry of Commerce anymore. After coal is under the supervision of the Ministry of Industry, according to the Mineral Act B.E. 2560.
Mr. Ronnarong Poolpipat, Director-General of the Department of Foreign Trade, revealed that on August 23, 2023, the Cabinet approved in principle the (draft) Ministry of Commerce announcement, canceling the Ministry of Commerce announcement.
Regarding the Export of Goods Outside the Kingdom (No. 86) B.E. 2541 B.E. … as proposed by the Ministry of Commerce in order to reduce legal duplication in regulating the export of coal originating within the country.
Since 2021, the Ministry of Industry, through the Department of Primary Industries and Mining, has issued an announcement on the type and condition of minerals prohibited from being exported outside the Kingdom or the continental shelf, B.E. 2021, by virtue of the Mineral Act B.E. 2017, prohibiting the export of coal originating in the Kingdom and the continental shelf, which has already come into effect.
The cancellation of the said announcement by the Ministry of Commerce means that imported coal can be freely exported without having to request permission from the Ministry of Commerce, which is in accordance with the resolution of the joint meeting with relevant agencies.
Consisting of the Department of Primary Industries and Mining, the Department of Mineral Fuels, the Department of Alternative Energy Development and Efficiency, the Customs Department, and the Electricity Generating Authority of Thailand, which will be effective from the day following the announcement in the Government Gazette onwards.
In the past, between 2020 and 2021, Thailand exported an average of 0.11 million tons of coal per year. In 2022, the volume was 0.18 million tons, worth 1,262 million baht.
Thailand’s main export sources are Cambodia (68%), Bangladesh (14%), and others (18%). Imports total 21 million tons, worth 94,895 million baht. The main import sources are Indonesia (70%), Australia (24%), and others (6%).
